The National Green Tribunal Has Stayed The CIDCO Sale Of A CRZ Site In Navi Mumbai.
The National Green Tribunal (NGT) suspended the auction of the 25,138.86 sq m Seawoods tender plot 2A with obvious impact. The land adjoins the NRI complex at Seawoods, Navi Mumbai, and is part of the CRZ-1A and CRZ-II zones. After hearing applications from two parties, the Western Zonal Bench of the NGT directed CIDCO to halt the competitive bidding.
According to sources, the Bench has ordered CIDCO three weeks to file a rebuttal, and the hearing is likely to continue on September 28, 2022.
The petitioners have urged the court to declare plot 2A as open space, as stipulated in the NMMC Development Plan, in addition to challenging the e-auction.
Earlier, environmental groups in Maharashtra had addressed the chief minister, indicating their worry about the tender auction of a large CRZ area. The parcel, which is 25,138.86 sq m and is adjacent to the NRI complex in Seawoods, is part of the CRZ-1A and CRZ-II zones. The hovercraft jetty and flamingo zones such as TS Chanakya wetlands and DPS lake are nearby.
The Seawoods tender plot 2A, which encompasses sectors 54, 56, and 58, has an FSI of 1.5 and has the potential to earn more than Rs 300 crore at the auction. The Maharashtra chief minister’s office has instructed the Ministry of Urban Development and the Environment Ministry to examine the allegation.
In its defence, CIDCO has mentioned a special instruction regarding the 2A plot at Nerul stating that:
- CIDCO has cited a unique order about the 2A plan at Nerul in its justification, noting that:
- There are no limitations on the sale or auction of CRZ-affected plots.
- According to the CZMP of 2011, which was authorised in 2019, the plot is part of CRZ-IA and CRZ-II, as noted in the marketing draw.
- According to the CRZ requirements, plot 2A is on the landward side of the road network and has no mangroves.
- The CRZ-IA region within plot 2A is in the mangrove buffer zone, not the mangrove zone.
- According to the court ruling and CRZ announcement, statutory authorization from the competent authorities is required for development in CRZ regions.
CIDCO further said that the allottee/lessee will be responsible for obtaining all required clearances from appropriate agencies for operations in the CRZ-impacted region.
Tender plot 2A is one of 16 properties put up for sale by CIDCO. Plot 2A is the auction’s largest land parcel, with a base rate of roughly Rs 1.17 lakh per sq metre and an EMD of around Rs 29.49 crore. The tender procedure was completed on August 18, 2022, with the outcomes to be announced on August 22, 2022.
